Filed Complaint against appraiser
Posted by ron river on September 13, 2021 at 8:38 pm19 Years of appraising and not one complaint. Now i have one and the state is looking into it. I have E & O Insurance and they will give me an attorney and pay up to 10k. Should i get the attorney before i speak with them or after i find out what the allegations area in depth?

November 9, 2021 at 10:15 amI have had a compliant filed against me once… and it was a lady that was mad cause she thought her home was under valued and the garbage disposal box was accidently checked, as such she though my appraisal abilities were sub par. No USPAP violations were made, my value was well supported and I fixed the incorrectly checked box. So if yours is similar to that.. then you will be fine. I talked with the compliant reviewer at the state and we laughed about it, got some constructive criticism and moved on.

February 20, 2022 at 11:28 pmThis is probably late to the game, but I had a legal action “threat” a couple years ago. I called E&O and they have a lawyer to consult with like once a year, free of charge. It was a nice option to talk it through, just in case.

February 24, 2022 at 12:54 pmGet the attorney and have them on hand. The state has attorneys and will use them at every step. The appraisal boards are not there to support the appraisers. If the state has notified you of the complaint then they are looking at action. Let the attorney reply to all communication. Most boards represent the community not the profession. My state had an investigator that thought she was smarter than everyone else and tried to prosecute every complaint. After retire from the board she back to private practice and caught creating comps, and lost her license. Guess she wasn’t so smart.

April 26, 2022 at 9:16 pmI have a question that I can’t believe I’m even involved with. I don’t even know how to ask it so I’ll back into it. I had refused a 203K job because 1) I no longer do 203K’s and 2) it was a property I had done an FHA report just 5 months earlier.
The property had conditions but the realtor couldn’t pull the deal together for a $5,600.00 compliance inspection. He wanted me to do a 203K on the property for the $5,600.00. I said No to the AMC. 7 minuets later he called with a little bitch fit.
Yes I tried to tell him he was not my client and I couldn’t talk to him. That I would not do a 203K on that property or any other property, I don’t do 203k’s. I must have told him that 20 times.
He sent me to the state for refusal to do the job. He claims I was slurring my speech as if I were drunk at 10:51AM??? I have a heart condition and don’t drink alcohol at all; I lose air quickly especially after 20 times.

May 12, 2022 at 7:42 amI’m flabbergasted. Turned in because you didn’t take an assignment type that you don’t do? Now I’ve heard it all. I don’t drink either, but I might start if this happened to me.

May 11, 2022 at 9:25 pmDont think there is a statement in USPAP to that effect. I would just say “not qualified” this covers
any assignment that you are unfamiliar with and have had no practice doing. That is somewhere in USPAP ..must not accept any assignment not competent for unless you are willing to take steps to educate yourself on how to do it”
